Kenya Association of Manufacturers (KAM) is in the process of collecting views on challenges faced by industries in the implementation of the Noise and Excessive Vibration Control regulation currently being enforced by the National Environmental Management Authority (NEMA).

The regulation, which was gazetted in May 2009 under Legal Notice 61, stipulates that any noise or vibration that can be heard beyond 30 meters will now attract a fine of Ksh. 350,000 or 18 months jail term. The regulation came to effect in November 2009 after a grace period of six months during which members of the public were required to adjust to this new regulation.

Under Part 11 of the regulation, any person wishing to (a) operate or repair any machinery, motor vehicle, construction equipment or any other equipment, pump, fan, air-conditioning apparatus or similar mechanical device or; (b) engage in any commercial or industrial activity which is likely to emit noise or excessive vibrations, shall carry out the activity or activities within the relevant levels prescribed in the first schedule to this regulations.  It further states that any person who contravenes this regulation commits an offence.
